| If your guide is taken by another web site without permission, DMCA 'em. |
| : | | | | |
| From: CJayC | Posted: 2/14/2004 12:10:40 AM | Message Detail |
You know the DMCA, the law that allows the RIAA to sue people for trading music? Well, it can be used by any copyright holder. If you wrote a guide, you own the copyright, and can use it to get your work taken off of most any site. Assuming both you and the infringer are in US, of course, but other countries have similar laws, and most will comply when the demand is made.
You see, thanks to the DMCA, the hosting provider of a site also becomes responsible for copyright infringement once they are made aware of it. So, if a certain webmaster refuses to take your guide down, you go over his or her head to the host and literally force it offline.
To find out who is hosting a site, you can take several steps. For most sites, the company providing their DNS resolution is also hosting them, and you can find out the DNS provider by performing a WHOIS lookup. NSI's lookup page (one of millions you can find out there) is here:
http://www.networksolutions.com/en_US/whois/index.jhtml
Once you know the name of the hosting provider and have confirmed them, you can contact them to find out how to send in a Copyright complaint. A phone call likely will get you the information you need right away, and believe it or not, faxing your complaint will often get you better service than e-mail, as you'll have a log of the call proving when and how you sent it, as well as proof they received it.
A DMCA-compliant complaint will require the following:
1) An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest (i.e. you, or your parents if you're a minor) 2) A description of the copyrighted work or other intellectual property that you claim has been infringed 3) A description of where the material that you claim is infringing is located on the site (the exact URLs; just saying "take my stuff down" doesn't work) 4) Your address, telephone number, and email address 5) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law 6) A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.
If you do this, it's almost guaranteed that your work will be removed. If you don't, it's a crapshoot. There is no other legal motivation for the ISP to become involved other than the DMCA, so it's in your own best interests to use it to your advantage.
If your work has been taken without your permission and you're upset about it, take action. If you don't stand up for your rights, you're just asking for them to be taken from you.
Oh, and someone copy this and post it for when people complain in the future that some site is taking their work...

This is exactly what I did when one of my FAQs was 'stolen'. And I got a very prompt reply. My FAQ was taken down within 3 hours of the email I sent. Didn't even have to actually contact the domain host. I just alerted the site owner of the steps I could take and a copy of his WHO_IS trace so he knew I meant business. Worked like a charm.

I just sent this:
If you aren't the person who takes care of these things, then I kindly ask that you pass this onto the person that is.
For some time now have I and other guide writers at GameFAQs fought with **** *******, webmaster of CCC (www.*******.com) to have our work removed. Actually, "fought" isn't exactly the right word. This is because he never bothers to even reply to our emails, let much less do what we ask.
The problem is, he hosts guides on his site without consent from the authors, or the owners of the intellectual property. Sure, he asks, but it doesn't matter what your answer is, he'll take it anyway.
All we ask is that he remove our stuff from his website. Some people allow him to host their work, and that's fine. A large majority, on the other hand, do not. Yet he still continues to steal people's work and display it. According to the DMCA, this is punishable by law.
I have tried contacting the site webmaster. I have even tried contacting inflow, but the last time I heard from them was over two months ago. To this date, no action has been taken.
Now unless Dave gets his act together, myself and countless others are going to issue a DMCA notice, and have all our work removed. So here is your chance to just take it all down now, and save both you and us the trouble. We have a big case, and if we decide to take this to court, we will easily win.
This is more or less a last ditch attempt to get my stuff taken off before I start getting serious.
The guide in question is my Dragon Ball Z Budokai FAQ/Move List, located here: http://www.*******.com/psx2/sg/dragon_ball_z_budokai.txt
Now unless action is taken soon, I will pursue the matter further.

Even without a legal notice, the reviews you've submitted are protected by the copyright law. You can plagiarize/copy/alter a review in the same way like an FAQ.
I wonder how someone can get modded for just saying "ok" in a topic, since I did see PowerMetal post with saying ok and now it is deleted for what reason I don't know.
Because it adds absolutely nothing to the conversation/topic and he was only posting here for the sake of posting in a CJayC topic. Which is lame enough to warrant a moderation (and yes, I know about MBA). And if it helps to keep those newbs away from these topics, I am all for it.
